GENERAL
Article 1 – Definitions and Concepts
SIA Boundless Inspiration – The Limited Company SIA Boundless Inspiration, located in Latvia, J. Asara iela 12k3-3, Riga LV-1009, registered with the Company Register of Latvia under number 40203455736, is the travel organizer who arranges tours and uses these Terms and Conditions.
Traveler – Any person who travels with SIA Boundless Inspiration, concludes or intends to conclude a travel contract and each person who is entitled to travel under the Agreement.
Travel service – Passenger transport, rental of a motor vehicle or motorcycle, accommodation or any other tourist service.
Travel service provider – The service provider that carries out part of the trip, such as auxiliary persons (accommodation providers/transporters/external guides/etc.) of SIA Boundless Inspiration.
Trip – an arranged tour of any length that is offered by SIA Boundless Inspiration.
Agreement – The travel agreement including these Conditions whereby SIA Boundless Inspiration provides a trip to the Traveler.
Written – In writing or by electronic means, including by e-mail.
Package holiday – A package holiday within the meaning of the law.
Travel sum – Price of a trip organized by SIA Boundless Inspiration.
Conditions – These general conditions of SIA Boundless Inspiration.
Article 2 – Applicability of conditions
2.1 Package Travel
These Conditions apply to all package travel offered by SIA Boundless Inspiration and form an inseparable part of it.
These Conditions apply to every offer, travel proposal, quote, and Agreement between SIA Boundless Inspiration and the Traveler, where SIA Boundless Inspiration has declared these Terms applicable unless it has been explicitly and in writing agreed by both parties that is not the case. Closing an Agreement with SIA Boundless Inspiration means that Traveler unconditionally accepts these Conditions.
2.2 Linked Travel Arrangements
These Conditions may also be declared applicable to Travel Services that are part of a linked travel arrangement. Regarding the Travel Services that are not part of the agreement with SIA Boundless Inspiration, the terms and conditions of the supplier of that Travel Service applies.
2.3 Deviating and additional conditions
Deviating and additional conditions must be agreed in writing. Deviating provisions in the individual agreement take precedence over these Conditions. The applicability of any purchase or other terms and conditions of the Traveler is expressly rejected.
In the event of conflicting provisions between these Conditions and the Agreement, the conditions included in the Agreement apply.
THE BOOKING
Article 3 – The Agreement
3.1 Content of the offer
The services and facilities offered on the Trip are expressly specified in quotes and publications from SIA Boundless Inspiration. The content of the offer is determined exclusively based on the information provided by or on behalf of SIA Boundless Inspiration. Information in publications of Travel Service Providers is not part of the offering, whether or not a link to it is included in the offering by SIA Boundless Inspiration. The stated travel time is indicated in whole days, where the day of departure and arrival are counted as whole days.
3.2 Non-binding offer
All quotes and offers by SIA Boundless Inspiration are not binding and after acceptance can in all cases be revoked by SIA Boundless Inspiration, without stating reasons until 5 p.m. of the next working day (Mon-Fri). This applies even if the Traveler has received an automatic confirmation of receipt of the booking.
3.3 Establishment of agreement
The Agreement is concluded by the Traveler’s acceptance of the offer from SIA Boundless Inspiration. The Traveler books the trip via the website of SIA Boundless Inspiration by completing the booking form truthfully and by accepting these Conditions. Through making of a booking, an Agreement is concluded between the Traveler and SIA Boundless Inspiration. For tailor-made trips, a quote is issued per email. A written (by e-mail) agreement on this offer is seen as a record of the Agreement.
3.4 Obvious Errors
Obvious errors in the offer do not bind SIA Boundless Inspiration. This applies to the price of an offer, the content of the service offered or other information of which the Traveler, in view of all circumstances, could not reasonably assume that SIA Boundless Inspiration intended this. If there is any reason to doubt the correctness of the price or information provided, the Traveler must inquire a clarification.
3.5 Special wishes
If the Traveler has certain preferences before or at the moment of booking the Trip, rights can only be derived from it if these preferences or special wishes have been accepted through a written commitment from SIA Boundless Inspiration. The single mention as a preference on travel documents and the booking confirmation is not sufficient.
3.6 Special requests
If the Traveler has special requests due to health conditions or other circumstances when entering into the Agreement (booking a tour), the start of the Agreement gets postponed until SIA Boundless Inspiration has confirmed that it can comply with these requests. SIA Boundless Inspiration must accept or deny this request within a reasonable period. In case of acceptance, the Agreement’s start moment is the date of the confirmation. If complying with the special requests means a change of price, a new offer is issued to the Traveler by SIA Boundless Inspiration.
3.7 Confirmation of receipt of the booking
If acceptance of the offer by the Traveler takes place electronically, SIA Boundless Inspiration confirms the receipt of this acceptance electronically as well.
3.8 Booking Confirmation
SIA Boundless Inspiration sends an email containing the booking confirmation immediately after booking the trip, together with a (down payment) invoice or not.
3.9 Cancellation by traveler
Booking online of the Trip is final. The Traveler has no right to revoke the Agreement.
3.10 Minors
The Traveler who books the trip must be older than 18 years. If a minor (<18 years) travels without the persons who have custody of the minor, they should send a signed declaration of consent to SIA Boundless Inspiration within 7 days after booking. In this case, contrary to paragraph 3 of this article, the Agreement will come into effect after receipt of this statement by SIA Boundless Inspiration.
3.11 Booking for other Travelers & communication
The Traveler who enters into an agreement on behalf of or for the benefit of one or more other Travelers is jointly and severally liable for all obligations arising therefrom. The other travelers are each liable for their own part. The confirmation, the invoice, the travel documents, and all other communication will only be sent to the Traveler making the booking. The Traveler who booked the Trip on behalf of or for the benefit of others must – with the consent of that person – inform SIA Boundless Inspiration about relevant personal circumstances of those other Travelers that may affect the performance of the Agreement when booking. The Traveler who books the Trip on behalf of or for the benefit of others, must provide the other travelers with these Conditions and other relevant communications.
INFORMATION
Article 4 – Information by SIA Boundless Inspiration
4.1 Travel sum
Stated prices are per person, unless specified otherwise. The travel sum offered includes all known unavoidable additional costs unless the costs cannot be included in the travel sum or are not yet known. In that case these costs or the nature of the costs are stated clearly next to the travel sum. If the travel sum is age-dependent, the age on the first day of the Trip is determinative.
4.2 Information by SIA Boundless Inspiration after booking
At the conclusion of the Agreement or immediately thereafter, SIA Boundless Inspiration provides the Traveler the Agreement including the accepted special requirements of the Traveler and general information about the necessary travel documents (passports, visas, etc.), any formalities regarding health and other legally required information.
4.3 Information by SIA Boundless Inspiration for the Trip
Before the Trip, the Traveler receives extensive information about the booked Trip, including information about the planned departure times, the latest check-in time, (in case air fares are included) the planned stopovers and arrival and, where applicable, the name of the airline operating the air transport.
4.4 Travel Documents
During the entire Trip, the Traveler must carry the necessary travel documents, such as passport, visa, vaccination certificates, etc. Given the fact this is crucial for the Trip, the Traveler is obliged to consult the authorities regarding the current requirements for travel documents additionally to the information received from SIA Boundless Inspiration. The Traveler must check the timelines of applying for and receiving any necessary travel documents (such as passport, visa etc.) before booking the Trip. Should the Traveler not be able to present valid travel documents before or during the Trip, the costs that arise for this are the responsibility of the Traveler.
4.5 Travel Documents
Where applicable, the travel documents (transport tickets, vouchers, etc.) are sent to the Traveler in time and at the latest 7 days before the Trip unless the invoice has not yet been paid in full. If the Traveler has not received the travel documents 5 days before departure, SIA Boundless Inspiration must be notified immediately. Final departure times and arrival times are stated in the travel documents.
4.6 Insurance information
SIA Boundless Inspiration can provide information about cancellation insurance and travel insurance. SIA Boundless Inspiration can oblige such insurance if the Traveler is informed about this requirement before booking the Trip.
Article 5 – Information by the Traveler
5.1 Relevant information from the Traveler(s)
Before or at the conclusion of the Agreement, the Traveler who makes the booking provides all information relevant to the Trip from themselves and those other Travelers who are registered by them. This concerns information about the Travelers or the composition of the group if this may affect health or safety of the Traveler or others during the Trip. If the information provided is incorrect or incomplete, this may result in the Traveler being excluded from participation in the Trip by SIA Boundless Inspiration or the Travel Service Providers. In this case the cancellation costs as stated in Article 9 paragraph 2 will apply to the Traveler. Other costs resulting from this situation will also be borne by the Traveler.
5.2 Reduced mobility, pregnant women, traveling alone, minors and illness
Travelers with reduced mobility and their companions, pregnant women, unaccompanied minors, and Travelers with an illness that may affect the Travel must inform SIA Boundless Inspiration about it when entering into the Agreement or as soon as the Traveler becomes aware of these facts due to possible consequences for the Trip and in particular air transport (if it is included). These Travelers must verify with the carrier whether a medical certificate is required to be allowed to travel. The Traveler is responsible for evaluating his/her physical and mental condition in relation to the desired journey. SIA Boundless Inspiration can’t rate whether a Traveler with health limitations (both physical and mental) is able to make a certain journey without any problems. In case of doubt, the Traveler should consult a doctor beforehand.
BEFORE THE TRIP
Article 6 – Payment
6.1 Deposit
After the Agreement has been concluded (the Trip booked on the website), the Traveler will receive a confirmation by email. Within 3 days after booking the Traveler will receive an invoice for 50% of the Price that has to be paid within 14 days from the date of the receipt. If airline tickets are included, the full amount of the airline tickets plus 50% of the travel sum for the remaining part of the Trip must be paid as a down payment.
6.2 Remaining Payment
The remainder of the travel sum must be paid no later than 6 weeks before the start date of the Trip. The Traveler will receive an invoice from SIA Boundless Inspiration for the remaining amount for the Trip no later than 2 months before the start of it.
6.3 Default and interest
If the Traveler does not pay within the term stated on the invoice, the Traveler is in default without further notice required to pay interest on the amount due.
6.4 Collection costs
Any collection costs that may occur in the event of invoices not being paid in time are borne by the Traveler.
6.5 Further consequences of non-payment
If payment is not made even after a reminder or not before the start of the trip, SIA Boundless Inspiration has the right to exclude the Traveler from participation. The obligation to pay remains. Instead of excluding the Traveler of participation SIA Boundless Inspiration may cancel the Agreement and charge the Traveler cancellation costs. Other rights of SIA Boundless Inspiration stay unaffected.
Article 7 – Substitution
7.1 Terms and Notice
A Traveler can transfer the Trip to another person who meets and accepts the terms and conditions associated with the Trip. The request for this change must be received by SIA Boundless Inspiration at least 7 days before the start of the Trip or earlier if the specifics of the Trip require that. Transfer is only possible insofar as the conditions of the concerned Travel service provider allow this. If airline tickets are part of the Trip, transfer of the airline tickets is generally not possible. Full trip transfer is then generally only possible if – at the expense of the Traveler – a new flight ticket is booked.
7.2 Joint and several liability and additional costs
The Traveler and the person who takes over the Trip are jointly and severally liable for the payment of the amount still due and for any additional fees, surcharges and other costs resulting from the substitution, including change costs.
Article 8 – Change by the Traveler
8.1 Change
The Traveler who has booked the Trip can submit a written request to SIA Boundless Inspiration to amend the Agreement. SIA Boundless Inspiration does not have to automatically comply with this. SIA Boundless Inspiration informs the Traveler about the new travel sum. If the Traveler agrees to the costs of the change, the new travel sum and change costs are due. If the new travel sum is lower than the original travel sum, the difference will be settled with the amount of the change costs.
8.2 Adjustment of departure date or number of travelers
A request to change the departure date does not constitute a change, but a cancellation. Reducing the number of paying passengers is not a change, but one partial cancellation. The cancellation scheme of Article 9 paragraph 2 [cancellation costs] applies to this situation.
Article 9 – Cancellation by the Traveler
9.1 Cancellation
The Traveler can cancel the Agreement at any time before the start of the Trip. Cancellation must be made in Writing. The date on which the Written cancellation by SIA Boundless Inspiration is received, is considered the moment of cancellation. When received after 5 pm or during the weekend, the next working day (Mon-Fri) is considered as the date of receipt.
9.2 Cancellation Charges
In the event of cancellation of the trip by the Traveler, the following cancellation costs are due to SIA Boundless Inspiration:
• up to 2 months before departure: 50% of the Travel Sum,
• from 2 months to 2 weeks before departure: 75% of the Travel Sum
• in case of cancellation from the 14th day (inclusive) to the day of departure or later: the full travel sum.
When third parties are involved, such as airlines and accommodation providers, and other cancellation conditions are applied, then any extra cancellation costs are passed on to the Traveler.
Article 10 – Price change
10.1 Price Change
SIA Boundless Inspiration may reserve the right to increase the Price for Agreements already entered up to 20 days before the day of departure. The Price increase may be due to price changes in fuel costs or other sources of energy, taxes or fees by parties not directly associated with SIA Boundless Inspiration or the performance of the Trip and/or exchange rates. The method for changing the Price must be known before the booking is completed.
10.2 Termination by Traveler
If the increase is more than 8% of the travel sum, the Traveler is entitled to terminate the agreement. In that case, the Traveler is entitled to immediate refund of the amounts paid. SIA Boundless Inspiration states a reasonable term within which the Traveler must make it known in Writing if he/she terminates the Agreement. If the Agreement has not been terminated within the term stated, the price increase is deemed to have been accepted and the right to termination ceases.
10.3 Price Reduction
If the right to a price change has been stipulated, the Traveler has, where appropriate, the right to request a price reduction in accordance with the price revision method.
Article 11 – Changes by SIA Boundless Inspiration
11.1 Changes
SIA Boundless Inspiration has the right to change the Agreement before the start of the Trip unilaterally insofar as it concerns minor changes. The Traveler gets informed about it in writing.
11.2 Significant Changes
If necessary, SIA Boundless Inspiration can change the main features of the Trip before the start date of it. This also includes offering an alternative Trip that is of at least equal quality. In that case, the Traveler can accept the change or terminate the agreement without paying cancellation costs.
11.3 Change in an agreed special requirement
If SIA Boundless Inspiration cannot comply with a reasonable effort to an agreed special wish of the Traveler, SIA Boundless Inspiration can change the Trip on this part. In that case, the Traveler can accept changes or terminate the Agreement without payment of cancellation costs.
11.4 Term
In case of major changes, SIA Boundless Inspiration sets a reasonable period within which the Traveler makes known in writing if the change is accepted. If the Agreement is not terminated by the Traveler within this period, the change is deemed to have been accepted and the right on termination lapses.
11.5 Price Reduction
If the change results in a reduction in the quality or costs of the Trip, the Traveler is entitled to an appropriate price reduction.
11.6 Notice
In case of major changes, SIA Boundless Inspiration must inform the Traveler about the following without any delay:
• the changes,
• the reasonable term within which the Traveler must notify SIA Boundless Inspiration in writing his decision whether the Traveler terminates the Agreement,
• the consequence that if the Traveler does not respond in time, the change will be considered as accepted and the right of termination lapses.
• if applicable, the content and price of the replacement Trip or the amount of the applicable price reduction.
11.7 Refund of paid travel sum
If the Traveler terminates the Agreement based on this article, the already paid travel sum will be refunded to the Traveler within 14 days.
11.8 Compensation if the change is rejected
If the Trip is terminated and the cause of the change is allocated to SIA Boundless Inspiration, it pays the Traveler an appropriate compensation. If the Trip is terminated and the cause of the change is attributed to the Traveler, the resulting expenses are for the Traveler. If the Trip is terminated and the cause of the change cannot be allocated to the Traveler nor to SIA Boundless Inspiration, the parties each bear their own damage.
Article 12 – Termination by SIA Boundless Inspiration
12.1 Termination
SIA Boundless Inspiration can cancel the Agreement before the start of the Trip and refund the Traveler all amounts paid for the Trip without having to pay compensation: a) if the number of registrations is smaller than that stated in the Agreement minimum number and the Traveler is notified of the cancellation within the agreed term, but no later than 60 days before the start of the Trip. b) in case of force majeure, which means unavoidable and extraordinary circumstances.
If a minimum number of participants is required for a Trip, SIA Boundless Inspiration confirms the Trip only when the minimum number of participants have booked the Trip and paid 50% of the Sum.
12.2 Refund of paid travel sum
In the above cases, SIA Boundless Inspiration pays the already received amounts immediately and at the latest within 14 days. Costs that are not reimbursed have been made by the Traveler for services that fall outside the Agreement such as vaccinations, visas, purchase of material, insurance and, if not included in the Trip, the flight, tickets, accommodation, etc.
12.3 Termination at the fault of the Traveler
If the Traveler does not meet the predetermined participation requirements or if the information provided by The Traveler or on behalf the Traveler is incomplete or incorrect regarding experience, skills, physical or mental condition or other relevant subjects, SIA Boundless Inspiration has the right to terminate the Agreement. This leaves other rights of SIA Boundless Inspiration unaffected.
PERFORMANCE OF THE TRIP
Article 13 – Responsibility
13.1 Proper execution of the Trip
SIA Boundless Inspiration is responsible for the performance of the Travel Services to which the Agreement relates, regardless of whether these Travel Services are provided by SIA Boundless Inspiration or by another Travel Service Provider.
13.2 Changes to Itinerary and Travel Times
SIA Boundless Inspiration will inform the Traveler about changes in the itinerary or travel times. If SIA Boundless Inspiration is not aware of the location of the Traveler, information will be sent to the, at SIA Boundless Inspiration, known email address or mobile phone number.
Article 14 – Conformity & non-conformity
14.1 Conformity
SIA Boundless Inspiration must perform the Agreement in accordance with the expectations that the Traveler has based on the publications, the Agreement, and the circumstances at the travel destination.
14.2 Passenger’s duty to complain
In accordance with Article 18, the Traveler informs the Travel Service Provider and SIA Boundless Inspiration without delay of any non-conformity that the Traveler has established during the performance of a Travel Service included in the Agreement.
14.3 Solution by SIA Boundless Inspiration
SIA Boundless Inspiration ensures that the reported non-conformity is remedied. The non-conformity need not be remedied if this is impossible because it entails disproportionately high costs considering the degree of non-conformity and the value of the relevant Travel Services.
14.4 Resolution by the Traveler
If the non-conformity is not remedied within a period set by the Traveler within a reasonable period, the Traveler has the option of remedying the non-conformity himself and request reimbursement of expenses.
14.5 Alternative Journey
If a significant part of the Travel Services cannot be performed as agreed, SIA Boundless Inspiration offers a suitable alternative, at no additional cost to the Traveler. The Traveler is entitled to a price reduction if the alternative is of lower quality. The Traveler can reject the offered alternative only if it is not comparable or the price reduction is insufficient.
14.6 Termination by the Traveler in case of significant consequences
If the non-conformity has significant consequences for the execution of the Trip and SIA Boundless Inspiration has not been remedied within a reasonable period set by the Traveler, the Traveler can terminate the Agreement without payment of cancellation fees. If the Agreement also includes transport, then SIA Boundless Inspiration provides repatriation of the Traveler with equivalent transport at no additional cost.
14.7 Price Reduction and Compensation
In the event of termination pursuant to the previous paragraph or if the Agreement is not terminated and no alternatives have been agreed, the Traveler is entitled to appropriate price reduction and appropriate compensation.
14.8 Price reduction conditions
If the Agreement is terminated based on the previous paragraph, the Traveler is entitled to a suitable price reduction for the period of non-conformity. Under no circumstances is the Traveler entitled to price reduction insofar as the non-conformity can be attributed to the Traveler.
Article 15 – Aid and assistance
15.1 Mandatory assistance
SIA Boundless Inspiration provides the Traveler with immediate help and assistance if the Traveler is in trouble, in particular by providing good information about medical services, local authorities, and consular assistance. SIA Boundless Inspiration also assists the Traveler in the use of remote communication and in finding alternative travel arrangements.
15.2 Charges
SIA Boundless Inspiration determines a reasonable fee for help and assistance if the difficulties have arisen due to intent or negligence on the part of the Traveler.
LIABILITY
Article 16 – Liability, compensation & exoneration
16.1 Damages
Compensation includes both damage suffered and compensation for loss in travel pleasure.
16.2 Attribution & force majeure
Under no circumstances is the Traveler entitled to compensation for damage suffered by the Traveler resulting from non-conformity, insofar as the non-conformity is due to:
a. the Traveler;
b. third parties who are not directly involved in the performance of the Agreement and the non-conformity could not be foreseen or prevented;
c. unavoidable and extraordinary circumstances.
Without prejudice to the provisions of these Terms and Conditions, SIA Boundless Inspiration is obliged to implement the Agreement in accordance with the expectations the Traveler could reasonably have under the Agreement. The implementation is to be judged by the customs, habits and restrictions imposed by the destination of the trip and the nature of the journey should be considered. If the trip does not proceed in accordance with the aforementioned expectations, the Traveler is obliged to inform the parties involved as soon as possible as referred to in Article 18.
SIA Boundless Inspiration is not liable for damage resulting from:
• shortcomings in the performance of the Agreement pursuant to
circumstances that can be attributed to the Traveler, including damage resulting from the health and physical condition of the traveler;
• circumstances not due to the fault of SIA Boundless Inspiration, or those that pursuant to the law or applicable standards in society are not reasonable to be imputed by SIA Boundless Inspiration;
• force majeure situations such as changes in timetables, war situations,
strikes, political conditions, mechanical breakdowns and natural disasters;
• theft, loss or damage to property such as luggage and travel documents;
• influence and actions of third parties not involved in the Agreement;
• the possession by the Traveler of in the host country prohibited substances and goods;
• the Traveler acting in violation of the law and morals of the country where he/she travels;
• errors made by transport companies;
• obvious errors in the travel program;
• damage for which travel and/or cancellation insurance offers coverage or implies to offer it.
TRAVELER OBLIGATIONS
Article 17 – Traveler Obligations
17.1 Conduct and Following Directions
The Traveler must behave as a reasonable Traveler and is obliged to follow all instructions to promote the proper execution of the Journey of SIA Boundless Inspiration and follow up with the Travel Service Providers.
17.2 Consequences of non-compliance – exclusion from participation
In the event of non-compliance with instructions or if a Traveler causes a nuisance, SIA Boundless Inspiration or the Travel Service Provider has the right to partially or completely deny the Traveler further participation in the Trip or Travel Service. In such a case, the Traveler is not entitled to a refund. Further costs incurred because of this are at the expense and risk of the Traveler.
17.3 Warning
Before proceeding to exclusion from participation, the Traveler first becomes a verbal or written warning. A warning is not required if the circumstances make it impossible for SIA Boundless Inspiration or the Travel Service Provider to do so considering the behavior of the Traveler, the expected chance of improvement of the behavior, the effect on the Trip and other Travelers, the risk of damage and the safety of the Traveler and others.
17.4 Traveler’s liability
The Traveler is liable for damage caused by his behavior, non-compliance of the obligations in this article or damage otherwise caused by him/her. Traveler indemnifies SIA Boundless Inspiration for claims from the Travel service providers involved in the Trip or other third parties, if the damage is caused by the Traveler or is attributable to him.
17.5 Possession of valid travel documents
The Traveler must ensure that he is in possession of the travel documents necessary upon departure, including a valid passport and visa where required, and the necessary vaccinations. The Traveler is also responsible for the correct name on (flight) tickets.
If the Traveler cannot make the trip (entirely) due to the lack of the required documents or vaccinations or a wrong name, the resulting costs are for the account of the Traveler. A refund of the travel sum is not possible in that case.
If the Traveler cannot make the trip (entirely) due to the lack of a (valid) travel document, then this comes with all associated consequences and extra costs resulting therefrom for his/her account.
If the Traveler has not received any travel documents at least five (5) working days before departure received, he/she immediately reports this to SIA Boundless Inspiration.
17.6 Insurance
Taking out travel insurance is mandatory for every Traveler. The Traveler sends a copy of this travel insurance to SIA Boundless Inspiration with all details no later than 14 days before departure.
Taking out cancellation insurance is strongly recommended.
OTHER PROVISIONS
Article 18 – Complaints
18.1 Information
SIA Boundless Inspiration provides its contact details before the start of the Trip in the event of an emergency and, where appropriate, its local agents or representative(s).
18.2 Reporting on the spot
If the Traveler believes that the Trip is being carried out non-compliantly, he/she must report this non-conformity immediately, but in any case during the Trip, to the relevant Travel service provider so that it can find a solution. If a tour guide or a travel agent of SIA Boundless Inspiration is on site, the complaint must be reported immediately to the tour guide or agent. If there is no tour guide on site, the complaint must be submitted to SIA Boundless Inspiration. This notification can be done by WhatsApp, SMS text message, telephone, or e-mail. SIA Boundless Inspiration confirms receipt of the complaint to the Traveler via the same medium as well as via email.
18.3 Communication Costs
The costs of the communication with SIA Boundless Inspiration concerning complaints come at the expense of SIA Boundless Inspiration. The Traveler must, as far as possible, reduce costs, for example by using internet calling, WhatsApp, and email.
18.4 Report unresolved complaint after return
All complaints that, according to the Traveler, have not or not fully been resolved or compensated during the Trip, must be submitted to SIA Boundless Inspiration within two months after return. SIA Boundless Inspiration is obliged to respond with reasons within one month of receipt of the complaint.
18.5 Consequences of not reporting or not reporting the non-conformity or complaint in a timely manner
Failure to submit a complaint or not to submit it in time in accordance with the second paragraph of this article may have an impact on the price reduction or compensation, unless the interests of SIA Boundless Inspiration have not been harmed by not submitting the complaint in time. Complaints that have not been received in time after return will not be processed unless this is not reasonable in the circumstances of the case.
Article 19 – Other provisions
19.1 Third Party Rights
Subordinates, auxiliary persons and other Third parties involved in the performance of the Agreement can invoke the provisions of the Agreement and these Terms.
19.2 Intellectual Property
The reproduction right on course material from the creative workshops is owned by the artist/facilitator and can be used only by the Traveler. The Traveler may not reproduce and/or use the material for commercial activities.
19.3 Applicable Law
To the offer, the Agreement and the performance of the Agreement the Law of Latvia applies.
19.6 Location and change of conditions
These Terms and Conditions are available on the SIA Boundless Inspiration website. The version of the moment of the booking applies to that Agreement. The Latvian text of the Conditions is always decisive for the interpretation thereof.
